Abstract:

Despite their importance, supranational enforcement institutions such as the International Centre for Settlement of Investment Disputes (ICSID) remain underexplored in international business research. Using 546 ICSID cases from 1972 to 2021, we examine how MNEs’ home- and host-country contexts shape arbitration outcomes. We find that MNEs from developing economies are less likely to prevail and receive smaller awards than firms from developed economies. While operating in a developing host country does not increase the likelihood of success, prevailing firms in such environments receive higher compensation. Interaction results further show that developing-country MNEs face the greatest disadvantage when filing claims against developed-country hosts. These findings highlight how institutional and geopolitical asymmetries systematically shape arbitration outcomes beyond legal merits alone.
